Terms of delivery and purchase


PRICES

All prices include statutory VAT. Please understand that our range of wines, vintage, prior sale and prices are subject to change. Availability of wines, obvious and typing errors reserved.


TERMS OF PAYMENT

New customers receive confirmation of their order and are  asked to pay the amount due by prepayment. The wines ordere will be delivered as soon as payment is received. After the first order, customers receive an invoice along with the wines. Payment is due net within 30 days. I will charge any deductions that were not agreed upon in a subsequent invoice.

CASH PAYMENT

Cash payment is not accepted.


RETENTION OF TITLE

Delivered goods remain property of vinigma gmbh until the purchase price has been paid in full. If payment is delayed, vinigma gmbh has the legal right to withdraw from the sales agreement and to register a retention of title. 


QUANTITY DISCOUNTS

Discounts are available on request for business customers.


DELIVERY TIMES

Normally, you will receive the goods within 7 working days following payment (first order) or placement of the order. If delivery is not possible within this period, you will be informed. Within Switzerland and Liechtenstein, goods are delivered by post, Vinolog, haulier or by vinigma gmbh. Should you have any complaints regarding loss, damage, leakage etc. during transport, please contact the delivery company directly. 


DELIVERY COSTS

Orders over 1,000.– chf are delivered free of charge within Switzerland. 

For orders under 1,000.– chf, the following charges apply:
20.– chf for Basel and the surrounding areas
30.– chf for the Canton of Graubünden and the city of Zurich
50.– chf for the rest of Switzerland

Delivery costs for post, Vinolog or haulier are charged to the customer. 

The costs for delivery abroad are calculated separately by order. 


CORKED WINE

As per resolution of the General Assembly of the Swiss Wine Merchant Association of 10 June 1988 and based on Article 197 of the Swiss Code of Obligations, wines bottled in Switzerland must be replaced or reimbursed within a year of delivery. Wines bottled in another country of origin are not replaced, unless the wine in question is exclusively sold by the producer (2 years). vinigma gmbh only replaces or reimburses bottles that are returned with the original cork and are at least three-quarters full. 


APPLICABLE LAW AND JURISDICTION

The minimum age for placing orders is 16 for wines and 18 for spirits. Swiss substantive law applies.
The Vienna Convention (CISG) is expressly excluded.
The exclusive place of jurisdiction for all legal disputes shall be Basel.
